- The murder is committed in the course of committing or attempting to commit kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction or retaliation, or terroristic threat. (This is a key distinction from general felony murder, as it specifies the underlying felonies.)
- The murder is committed for remuneration (for payment or promise of payment) or the defendant employs another to commit the murder for remuneration.
- The murder is committed while escaping or attempting to escape from a penal institution.
- The person murders more than one person during the same criminal transaction, or during different criminal transactions, but pursuant to the same scheme or course of conduct.
- The victim is an individual under 10 years of age.
- The victim is an individual 10 years of age or older but younger than 15 years of age (added by Lauren's Law).
